Public Consultation on the Draft Implementing Regulation of Government Regulation No. 17 of 2025 concerning the Governance of Electronic System Operations for Child Protection

Jakarta, INTI - In accordance with the provisions of Law No. 12 of 2011 on the Formation of Laws and Regulations, as amended, particularly regarding public participation in the drafting of legislation, it is deemed necessary to conduct a public consultation on the Draft Ministerial Regulation of Communication and Digital Affairs concerning the Implementation of Government Regulation No. 17 of 2025 on the Governance of Electronic System Operations for Child Protection (Draft Regulation on the Implementation of the TUNAS Government Regulation).

To follow up on the provisions stipulated in Article 6, Article 20 paragraph (5), Article 27 paragraph (2), Article 29 paragraph (10), Article 36, and Article 47 paragraph (6) of Government Regulation No. 17 of 2025 on the Governance of Electronic System Operations for Child Protection, a Draft Ministerial Regulation needs to be formulated. The Draft Ministerial Regulation is intended to regulate the following matters:

Chapter I - General Provisions 

This chapter sets out general definitions containing the key terms used in the substantive provisions of the Draft Ministerial Regulation, as well as the scope of the Regulation, which includes: information on the minimum age limits for children to access Products, Services, and Features; risk profile assessments of Products, Services, and Features; and the supervision of Electronic System Operations for the purpose of child protection.

Chapter II - Information on Minimum Age Limits for Children to Use Products, Service, and Features

This chapter regulates the minimum age requirements for children to access Products, Service, and Features operated and developed by Electronic System Providers (ESPs), as well as the obligation of ESPs to conduct self-assessments to ensure that the Product, Services, and Features they develop comply with the prescribed minimum age limits and applicable age ranges for children. 

Chapter III - Risk Profile Assessment of Product, Services, and Features

This chapter sets out the obligation of Electronic System Providers (ESPs) to assess the level of risk associated with the Products, Services, and Features they develop and/or operate. It also outlines the indicators used for evaluating such risks, as well as the mechanisms for verifying the results of the self-assessments conducted by ESPs. 

Chapter IV - Supervision of Electronic System Operations for Children Protection 

This chapter regulates oversight measures, including general supervision, monitoring and/or tracing activities, the submission of reports or complaints, preliminary examinations, and follow-up examinations. 

Chapter V - Administrative Sanctions 

This chapter stipulates provisions on administrative sanctions, including the enforcement and notification of decisions regarding the imposition of such sanctions.

Chapter VI - Procedures for Submitting Objections to Decisions or Administrative Actions 

This chapter regulates the procedures for submitting objections, including the right of Electronic System Providers (ESPs) subject to administrative sanctions to file objections, the mechanisms for resolving objections related to administrative sanctions, and the procedures for filing administrative appeals against decisions imposing such sanctions. 

Chapter VII - Transitional Provisions 

Chapter VIII - Final Provisions 

To further the regulation and strengthen meaningful public participation, the Ministry of Communication and Digital Affairs invites the public and all stakeholders to submit feedback on the Draft Ministerial Regulation implementing the TUNAS Government Regulation. The public consultation will be open until January 16, 2026, and inputs may be submitted via email to fara004@komdigi.go.id.

Conclusion 

The public consultation on the Draft Ministerial Regulation marks an important step in strengthening the governance of electronic systems for child protection in Indonesia. By encouraging meaningful participation from all stakeholders, the initiative aims to ensure that the regulation is comprehensive, balanced, and effectively implemented to create a safer digital environment for children.
