Copyright Protection Included in Indonesias Draft AI Regulation

Jakarta, INTI – Deputy Minister of Communication and Digital (Wamenkomdigi) Nezar Patria emphasized that the draft Presidential Regulation (Perpres) on Artificial Intelligence (AI) will accommodate copyright concerns related to the use of the technology. Nezar delivered this statement in response to public concerns over the protection of creative works amid the rapid growth of AI.

Coordination with the Ministry of Law

In his remarks at the Komdigi Office, Central Jakarta, Friday 29,August Nezar explained that his ministry has coordinated with the Ministry of Law to ensure copyright issues are not overlooked in the drafting of the new regulation.

“So we are also coordinating with the Ministry of Law regarding copyright. We hope that in the process of formulating this Perpres, copyright issues can be accommodated,” said Nezar.

The AI draft regulation is expected to serve as an umbrella regulation that sets out general principles for the development and use of artificial intelligence across sectors in a horizontal manner.

Strengthening Digital Regulations

According to Nezar, the AI Presidential Regulation will strengthen the series of digital regulations previously issued by the government, such as the Circular on AI Ethics, the Electronic Information and Transactions (ITE) Law, the Personal Data Protection (PDP) Law, as well as several other implementing regulations related to electronic system operators (PSE).

With the issuance of the AI Perpres, all sectors adopting AI technology will have a common set of horizontal principles to refer to. “So when AI is adopted in these sectors, it can be guided by horizontal principles or general norms,” Nezar added.

Target Completion September 2025

Nezar stated that the drafting process of the AI Perpres is targeted for completion in September 2025. The regulation is currently undergoing harmonization with the Ministry of Law and the State Secretariat to ensure it does not overlap with existing rules.

This regulation will also emphasize the application of principles of transparency, accountability, safety, and respect for copyright.

Upholding Pancasila Values

Nezar stressed that AI ethics principles will be incorporated into the Perpres. This is to ensure that the regulation is not merely technical but also grounded in the nation’s fundamental values.

“All the principles of AI ethics are accommodated in the regulation, including the requirement to reflect the fundamental values of our society and state, namely Pancasila,” he explained.

The draft AI Presidential Regulation marks an important milestone in presenting a regulatory framework that balances technological development with copyright protection. With a target completion in September 2025, the regulation is expected to become a key reference for various sectors in implementing AI that is ethical, safe, and aligned with Pancasila values.
