Jakarta, INTI - The Special Committee of the Indonesian House of Representatives (DPR RI) on the Industrial Design Bill is calling for regulations that clearly distinguish between human creativity and the use of artificial intelligence (AI) in creating industrial designs.
The committee believes the growing use of AI among the public and industry players needs to be addressed through regulation while maintaining clarity over the human contribution to a particular design.
AI to Remain a Supporting Tool
Lola Nelria Oktavia, Deputy Chair of the DPR RI Special Committee on the Industrial Design Bill, said the rapid adoption of AI should be taken into consideration when developing industrial design regulations.
“AI has developed rapidly and is now widely used. However, there must be clear boundaries in how AI is incorporated into the regulatory framework. We need to distinguish between human creativity and the role of AI,” Lola said while leading a working visit by the committee to the Regional Office of the Ministry of Law in North Sumatra, Medan, on Friday, September 25, 2026.
According to Lola, input from workers and MSME (micro, small, and medium-sized enterprise) players in North Sumatra is important in formulating the provisions, as technology is increasingly needed to support creative processes and improve competitiveness.
The Industrial Design Bill is expected to accommodate the use of emerging technologies while maintaining clarity regarding human contributions and the parties holding rights to a particular design.
DPR RI Special Committee member Tonny Tesar said AI could be used in the design creation process, but its legal status should remain that of a tool rather than a legal subject.
“AI is a tool, not a legal subject. Therefore, its use is not prohibited. However, it should be disclosed when AI is used in creating a design,” Tonny said.
AI Use Should Be Disclosed in Design Creation
Tonny explained that AI could help businesses, including MSMEs, develop products and designs with economic value.
The technology can support creative processes, including packaging development and product innovation.
However, the use of AI should be accompanied by transparency regarding the technology’s involvement, allowing the human contribution to the design process to be clearly identified.
Such provisions are also considered necessary to distinguish fully AI-generated outputs from works that involve a human creative process.
AI regulation is among the aspects being considered in the drafting of the Industrial Design Bill, with the aim of ensuring that regulations can keep pace with technological developments while providing greater certainty for industry players and MSMEs.
The DPR RI Special Committee is also gathering input from academics, practitioners, industry players, and local governments through working visits to several regions.
The feedback will serve as material for further discussions on provisions for industrial design that can address technological developments and the needs of businesses.
